Beneficial Owner
The beneficial owner (*) is defined as:
- The individual that effectively and finally owns or controls legal persons or legal arrangements as set forth in Section 4 of the regulation; and/or.
- The individual that ultimately owns or controls a client or on behalf of whom a transaction is made.
The expression “ultimately owns or controls” or ultimate effective control refers to situations in which ownership and/or control is exerted through a chain of ownership or through any other method of control that is not a direct control while the “client” (**) defines it as any local or foreign individual or legal person requesting and receiving from the liable taxpayer, the rendering of a service, the provision of goods or a product.

The meanings of beneficial owner contained in subparagraph a) I of paragraph 3.1 of Section 3 of Legislative Decree 1372 are applicable, as appropriate, for the purposes of the aforementioned Legislative Decree, the applicable complementary regulations and those referring to mutual administrative assistance in tax matters, as well such as those that regulate the System ofAnti- Money Laundering and the Financing of Terrorism.
