Professionals on legal services or accounting and finance will not be able to refuse to provide information requested by competent authorities by invoking the right to professional secrecy when they act in their capacity of, among others:
- company members
- partners
- shareholders
- stakeholders
- legal representatives
- proxy
- administrators
- directors
- members of the Board of Directors or
- hold the status mentioned in items a) and b) of paragraph 4.2, Section 4 of the Legislative Decree 1372.
The identification of beneficial owners of legal persons and legal arrangements provided to competent authorities in compliance with the Law, by the above mentioned professionals does not represent a breach of professional secrecy; also, it is not subject to restrictions on disclosure of information arising from confidentiality established by contract or any other legal or regulatory provision.
The provisions mentioned in previous paragraphs also apply to the Notary Public, as appropriate.
